In Chapter 5, you learned the critical role that discretion plays in the criminal justice system. Prosecutors have the power to exercise wide latitude with their decisions regarding whether or not to charge a person with a crime and judges have the power to determine whether or not bail will be set and at what amount, and what sentence if any to impose upon a defendant convicted of a crime.
Read this article above which discusses prosecutorial discretion and how that power can be abused. In a 1-2-page paper, describe how at least 3 different actors in a courtroom exercise discretion and discuss how that power can be abused.
Each full-page should include at least three complete paragraphs. Margins are to be 1″ on all four sides, Times New Roman font, size 12, double-spaced lines. Save documents as Rich Text Files (RTF) or word.doc files — no exceptions. Excessive grammatical and spelling errors are unacceptable, so edit and revise carefully. Use APA formatting when citing sources and include a reference page.
